About this Notice
This Notice of Privacy Practices (“Notice”) describes the privacy practices of Usable Health, PC and its affiliated clinicians (collectively, “the Practice,” “we,” “us,” or “our”) with respect to protected health information (“PHI”) created or received in connection with the telehealth services accessed through OnlineSemaglutide.org. OnlineSemaglutide.org is operated by Pacific Shores Research Group, LLC as the technology platform; the medical services are provided by the Practice through independently licensed clinicians, and prescriptions are filled by independently licensed 503A compounding pharmacies (see “Who receives your information” below).
This Notice applies to all PHI created, received, or maintained by the Practice in connection with your use of the OnlineSemaglutide.org telehealth services. It does not apply to information that is not PHI (for example, information you provide to us before you become a patient that is governed solely by our Privacy Policy).
Our pledge regarding your protected health information
We understand that information about your health is personal. We are required by federal law (the Health Insurance Portability and Accountability Act of 1996, as amended, or “HIPAA”) and applicable state law to maintain the privacy of your PHI, to provide you with this Notice of our legal duties and privacy practices, to abide by the terms of the Notice currently in effect, and to notify you following a breach of unsecured PHI.
How we may use and disclose your PHI without your authorization
The following categories describe the ways we may use and disclose your PHI without your written authorization. Not every use or disclosure in a category will be listed; however, all of the ways we are permitted to use and disclose your PHI without authorization fall into one of these categories.
For treatment
We use and disclose your PHI to provide, coordinate, or manage your health care and related services. For example, we share your intake information with the prescribing clinician who reviews your case and, when a prescription is appropriate, transmit the prescription and necessary clinical information to the independently licensed 503A compounding pharmacy that fills your prescription.
For payment
We use and disclose your PHI as necessary to obtain payment for the services we provide — for example, to process your payment information through our payment processor or to bill you for a visit fee.
For health care operations
We use and disclose your PHI for activities necessary to operate the Practice, including quality assessment and improvement, clinical reviews, licensing and credentialing, training, compliance, audits, and certain business management activities.
As required by law
We will disclose your PHI when required to do so by federal, state, or local law.
Other permitted uses and disclosures
We may use or disclose your PHI without your authorization for: public health activities; reporting suspected abuse, neglect, or domestic violence; health oversight activities; judicial and administrative proceedings (in response to a valid court order, subpoena, or discovery request that meets HIPAA requirements); law enforcement purposes (within HIPAA limits); to coroners, medical examiners, and funeral directors; for organ and tissue donation; for research approved by an Institutional Review Board or Privacy Board; to avert a serious threat to health or safety; for specialized government functions (including military, national security, and protective services); and for workers’ compensation claims.
Who receives your protected health information
In the course of providing telehealth services to you, your PHI may be disclosed to the following categories of recipients:
- Treating clinicians who are licensed in your state and who review your intake, conduct your consultation, and (when appropriate) prescribe medication.
- Independently licensed 503A compounding pharmacies that fill your prescription. Our current pharmacy partner network includes Belmar Pharmacy, Strive Pharmacy, Epiq Scripts, and Casa Pharma Rx. Each pharmacy operates under its own state licensure, maintains its own Notice of Privacy Practices, and is bound by a Business Associate Agreement with us where applicable.
- The technology platform operator, Pacific Shores Research Group, LLC (operator of OnlineSemaglutide.org), in its role as a Business Associate.
- The telehealth software vendor that hosts our intake, scheduling, messaging, and electronic health record functions, in its role as a Business Associate.
- The payment processor that handles your billing transactions, in its role as a Business Associate (for payment information that is also PHI).
- Other Business Associates we engage to provide services on our behalf (for example, secure email or SMS, document storage, analytics, customer support). Each Business Associate is bound by a written agreement that requires it to safeguard your PHI and use it only for the purposes we specify.
- Government agencies and other recipients in the limited circumstances described above under “How we may use and disclose your PHI without your authorization.”
Uses and disclosures that require your written authorization
The following uses and disclosures will be made only with your written authorization: (1) most uses and disclosures of psychotherapy notes; (2) uses and disclosures of PHI for marketing purposes, with limited exceptions; (3) any sale of your PHI; and (4) any other use or disclosure not described in this Notice. You may revoke any authorization in writing at any time, except to the extent that we have already taken action in reliance on it.
Your rights regarding your protected health information
Right to inspect and copy
You have the right to inspect and obtain a copy of the PHI we maintain about you in a “designated record set,” in the form and format you request if it is readily producible in that form and format (including an electronic copy if the information is maintained electronically). We may charge a reasonable, cost-based fee. Limited exceptions apply.
Right to amend
You may request that we amend PHI we maintain about you if you believe it is incorrect or incomplete. We may deny your request in certain circumstances; if we deny your request, we will explain why and how to file a statement of disagreement.
Right to an accounting of disclosures
You have the right to receive an accounting of certain disclosures we have made of your PHI in the six years prior to your request, excluding disclosures for treatment, payment, or health care operations and certain other categories permitted by HIPAA.
Right to request restrictions
You have the right to request restrictions on certain uses and disclosures of your PHI. We are not required to agree to your request except in the case of a disclosure to a health plan for payment or health care operations where you have paid for the service in full out of pocket and the disclosure is not otherwise required by law.
Right to confidential communications
You have the right to request that we communicate with you about medical matters in a certain way or at a certain location (for example, by mail only, or at a specific phone number). We will accommodate reasonable requests.
Right to a paper copy of this Notice
You have the right to receive a paper copy of this Notice at any time, even if you have agreed to receive it electronically. To request a paper copy, contact our Privacy Officer using the information below.
Right to be notified of a breach
You have the right to receive notification in the event of a breach of your unsecured PHI, as required by HIPAA’s Breach Notification Rule.
Our duties
We are required by law to maintain the privacy of your PHI, to provide you with notice of our legal duties and privacy practices with respect to your PHI, to abide by the terms of the Notice currently in effect, and to notify you following a breach of unsecured PHI.
Changes to this Notice
We reserve the right to change this Notice and to make the revised Notice effective for PHI we already have about you as well as any PHI we receive in the future. The current Notice will always be available on OnlineSemaglutide.org and will be provided to you upon request. The effective date of the current Notice is shown at the top of this page.
Complaints
If you believe your privacy rights have been violated, you may file a complaint with our Privacy Officer (contact information below) or with the Secretary of the U.S. Department of Health and Human Services. Complaints to HHS may be filed at www.hhs.gov/hipaa/filing-a-complaint or by mail or phone (Office for Civil Rights toll-free: 1-800-368-1019; TDD: 1-800-537-7697). We will not retaliate against you for filing a complaint.
